Privacy policy

At THENAUTICSTORE.COM (the “Website”) we process your personal data transparently and only as far as necessary. On this page we explain what data we collect, why, for how long, who we share it with and how you can exercise your rights.

This policy complies with Regulation (EU) 2016/679, the General Data Protection Regulation (GDPR), Spanish Organic Law 3/2018 on the Protection of Personal Data and the guarantee of digital rights (LOPDGDD) and Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE).

2. What data we process

We only process the data needed for each purpose:

• Identification and contact data: first name and surname, email, phone number and postal address.
• Billing data: tax ID / ID number, company name and, where applicable, intra-Community VAT number (VIES).
• Order data: products purchased, amounts, payment method, shipments, returns and incidents.
• Warranty and customer service data: serial number, maintenance invoices or records, photos and videos of the product, and the communications you have with us.
• Customer account data: username, password (encrypted) and order history.
• Browsing data: IP address and data collected through cookies, as explained in our Cookie Policy.

We do not store your bank card details: payment is processed directly by the bank’s secure payment gateway. We do not process special categories of data (health, beliefs, etc.).

3. Why we use your data and on what legal basis

1. Managing your orders: processing the purchase, payment, shipping, returns and delivery incidents. Legal basis: performance of the sales contract.
2. Invoicing and legal obligations: issuing invoices, keeping accounts and complying with tax and consumer obligations. Legal basis: compliance with legal obligations.
3. Warranties and customer service: handling enquiries, complaints and warranty claims. Legal basis: performance of the contract and compliance with legal obligations.
4. Customer account: allowing you to view your orders and invoices. Legal basis: performance of the contract.
5. Answering enquiries sent via form, email or phone. Legal basis: your consent and, where applicable, taking pre-contractual steps at your request.
6. Marketing communications about products and offers:
   • If you are a customer, we may send you information about products similar to those you bought. Legal basis: legitimate interest (art. 21.2 LSSI-CE).
   • If you are not a customer, only if you have expressly subscribed. Legal basis: your consent.
   • You can unsubscribe at any time using the link included in each communication or by writing to us.
7. Fraud prevention and security of the Website and payments. Legal basis: legitimate interest.
8. Statistics and improvement of the Website through analytics cookies. Legal basis: your consent, which you can withdraw from the cookie settings panel.

We do not make decisions based solely on automated processing that produce legal effects concerning you. If you choose instalment payment with SeQura, SeQura, as an independent controller, will assess your application in accordance with its own privacy policy.

4. How long we keep your data

• Orders, invoices and accounts: for the periods required by law (6 years under the Spanish Commercial Code, and the periods set by tax legislation).
• Warranty and complaints: for the duration of the product warranty and, thereafter, for the period during which liability may be claimed.
• Customer account: while you keep it active. If you delete it, we will keep blocked the data that the law requires us to retain.
• Enquiries: for the time needed to answer them and follow them up.
• Marketing communications: until you unsubscribe or object.
• Cookies: according to the periods indicated in the Cookie Policy.

After these periods, the data is deleted or anonymised.

5. Who we share your data with

We do not sell your data. We only disclose it to third parties when necessary to provide the service or when required by law:

• Carrier (DHL): name, address, phone number and email, to deliver the order and manage collections and incidents.
• Banks and payment gateways: to process payment and, where applicable, refunds.
• SeQura: if you choose instalment payment.
• Manufacturers and technical services: when necessary to handle a warranty claim for a product of another brand.
• Public authorities: Tax Agency, customs, courts or other bodies, when required by law.
• Service providers processing data on our behalf (website and online store hosting, email, accounting and tax advisers, IT support). All of them have signed a data processing agreement with us and may only use the data according to our instructions.

International transfers: if any provider processes data outside the European Economic Area, it will do so only with the safeguards required by the GDPR (European Commission adequacy decisions or standard contractual clauses).

6. Accuracy of data and minors

The User guarantees that the data they provide is true, accurate and up to date, and is responsible for informing us of any changes. If they provide data of another person (for example, a different recipient), they declare that they have that person’s authorisation.

You must be over 18 years of age to buy on the Website. We do not knowingly process data of children under 14 without the consent of their parents or guardians.

7. Security

We apply technical and organisational measures appropriate to the risk to protect your data against loss, alteration or unauthorised access. The Website uses an SSL certificate, so data travels encrypted between your browser and our server.

No system on the internet is completely invulnerable. If a security breach occurred that posed a high risk to your rights, we would inform you without undue delay and notify the Spanish Data Protection Agency where appropriate. Our staff and our providers are bound to keep your data confidential.

8. Your rights

You can exercise the following rights at any time, free of charge:

• Access: find out whether we process your data and obtain a copy.
• Rectification: correct inaccurate or incomplete data.
• Erasure: ask us to delete your data when it is no longer needed, unless the law requires us to keep it.
• Objection: object to processing, for example, to receiving marketing communications.
• Restriction: ask us to stop using your data temporarily, for example, while its accuracy is being checked.
• Portability: receive your data in a structured, commonly used format, or have us send it to another company.
• Withdraw your consent at any time, without affecting earlier processing.
• Not to be subject to automated decisions that significantly affect you.

How to exercise them: send an email to info@thenauticstore.com with the subject “Data protection”, stating which right you wish to exercise. If you write from the email linked to your account or your orders, usually nothing else will be needed. If we have reasonable doubts about your identity, we may ask you for additional information to verify it. You can also write to us by post at Calle Bismuto 8, 30369 Los Camachos (Murcia), Spain.

We will reply within one month, which may be extended by two further months in complex cases, in which case we will let you know.

Complaint to the supervisory authority: if you believe we have not handled your data properly, you can file a complaint with the Spanish Data Protection Agency (www.aepd.es) or with the supervisory authority of your country of residence in the European Union. We would be grateful if you contacted us first so that we can try to resolve it.

9. Links to other websites

The Website may include links to third-party pages (manufacturers, videos, carrier, etc.). These pages have their own privacy policies, for which we are not responsible. We recommend reading them before providing your data.

10. Changes to this policy

We may update this policy to adapt it to legal changes or changes in our services. We will always publish the current version on this page, with its update date. If the changes are significant, we will inform you by email or by a prominent notice on the Website.
